Terms of Service

These terms apply specifically to Clients using the Yash Talent platform.
1. About These Terms
These Terms of Service (“Terms”) form a legally binding agreement between you (“Client”, “you”, “your”) and Yash Talent Ltd, a company registered in England and Wales (“Yash Talent”, “we”, “us”, “our”), in connection with your use of the Yash Talent platform, accessible at yashtalent.co.uk (“Platform”).
By registering an account, browsing the Platform, or making a booking, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy. If you do not agree, you must not use the Platform.
These Terms are governed by the laws of England and Wales. Any disputes arising from them will be subject to the exclusive jurisdiction of the courts of England and Wales.
2. Who We Are
Yash Talent Ltd is a creative talent marketplace that enables clients (“Clients”) to discover, contact, and book professional creative service providers, including sole-trader creatives (“Creatives”) and creative talent agencies (“Agencies”).
Yash Talent acts as an introduction and booking platform only. We are not a party to the service contract between you and any Creative or Agency, nor do we employ, represent, or guarantee the work of any Creative or Agency listed on the Platform.
3. Creating an Account
3.1 Eligibility
You must be at least 18 years old and a resident of the United Kingdom to register as a Client. By creating an account you confirm that all information you provide is accurate and up to date.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hello@yashtalent.co.uk if you suspect any unauthorised use of your account.
3.3 Accurate Information
You agree to provide accurate, current, and complete information when registering and to update it promptly if it changes. We reserve the right to suspend or terminate accounts containing false, misleading, or fraudulent information.
4. Browsing and Booking
4.1 Listings
Listings on the Platform are created and managed by Creatives and Agencies. Yash Talent does not guarantee the accuracy, completeness, or fitness for purpose of any listing. You are responsible for conducting your own due diligence before making a booking.
4.2 Fixed-Price Bookings
Where a listing offers a fixed-price service, you may request a booking by selecting your preferred date and completing the checkout process. A booking is confirmed only upon successful payment and written confirmation from Yash Talent. The Creative or Agency retains the right to decline a booking request within 24 hours of receipt, in which case you will receive a full refund.
4.3 Enquiry Bookings
Where a listing is marked “Enquiry Only”, clicking “Send Enquiry” initiates a conversation with the Creative or Agency. No contract or booking exists until both parties have agreed on scope, price, and dates, and payment has been processed through the Platform.
4.4 Off-Platform Transactions
All payments for services booked through the Platform must be made through the Platform's payment system. Transacting off-platform to circumvent our fees is a material breach of these Terms and may result in immediate account suspension.
5. Payments and Fees
5.1 Payment Processing
Payments are processed securely via our third-party payment processor (Stripe). By submitting a payment, you authorise Yash Talent to charge your chosen payment method for the booking total, including any applicable service fees displayed at checkout.
5.2 Client Service Fee
A platform service fee is added to each booking and displayed clearly before payment is confirmed. This fee covers platform operation, payment processing, and buyer protection.
5.3 Taxes
You are responsible for any taxes applicable to your purchases under the laws of your jurisdiction. Prices displayed are inclusive of VAT where applicable.
6. Cancellations and Refunds
6.1 Your Cancellation
Cancellation terms are set individually by each Creative or Agency and displayed on their listing. Where no specific policy is stated, the following defaults apply:
- More than 14 days before the event date: full refund minus payment processing fees.
- 7–14 days before the event date: 50% refund.
- Less than 7 days before the event date: no refund.
6.2 Provider Cancellation
If a Creative or Agency cancels a confirmed booking, you will receive a full refund including all fees. We will also make reasonable efforts to assist you in finding an alternative provider.
6.3 Disputes
If you are dissatisfied with the service received, you should first contact the Creative or Agency directly. If the matter cannot be resolved, you may escalate it to Yash Talent at hello@yashtalent.co.uk within 7 days of the event. We will review the dispute and may offer remedies at our sole discretion, but we are under no obligation to provide refunds for completed services.
6.4 Consumer Rights
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.
7. Your Obligations
By using the Platform as a Client, you agree to:
- Treat all Creatives and Agencies with respect and professionalism.
- Provide accurate event details, location, and requirements when making a booking.
- Be present or ensure a nominated representative is present at the agreed time and location.
- Not use the Platform to harass, defame, or discriminate against any user.
- Not submit false, misleading, or malicious reviews.
- Comply with all applicable laws in relation to your use of the Platform and the services you receive.
8. Reviews
After a completed booking, you may be invited to leave a review. Reviews must be honest, fair, and based on your genuine experience. Yash Talent reserves the right to remove reviews that violate our community standards, including those that are defamatory, discriminatory, or fraudulent. Fake or incentivised reviews are strictly prohibited.
9. Intellectual Property
All content on the Platform — including text, graphics, logos, and software — is the property of Yash Talent Ltd or its licensors and is protected by UK and international copyright law. You may not reproduce, distribute, or create derivative works from any Platform content without our prior written permission.
Any content you submit to the Platform (including messages and reviews) is licensed to Yash Talent on a non-exclusive, royalty-free basis for the purposes of operating the Platform.
10. Limitation of Liability
To the maximum extent permitted by law, Yash Talent's total liability to you in connection with the Platform and any booking shall not exceed the total amount paid by you to Yash Talent in the 12 months preceding the claim.
We are not liable for:
- The quality, safety, or legality of services provided by any Creative or Agency.
- Any loss of profits, revenue, or data arising from your use of the Platform.
- Any failure or delay caused by circumstances beyond our reasonable control.
- The acts or omissions of third parties, including payment processors.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes in law, our services, or business practices. We will notify you of material changes by email or by displaying a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms.
12. Termination
You may close your account at any time by contacting us at hello@yashtalent.co.uk. We reserve the right to suspend or terminate your account immediately, without notice, if you breach these Terms or if we reasonably suspect fraudulent activity.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where you are a consumer resident in another part of the UK, in which case you may also bring proceedings in the courts of Scotland or Northern Ireland.
